Foreign foundations seeking to expand in El Salvador must meet the following requirements:<\/h3>\n

  1. Certification from the registration authority in the country of origin.<\/li>\n
  2. Certified copy of the Foundation’s Statutes.<\/li>\n
  3. Certification of the Minutes of the General Assembly approving the opening in El Salvador.<\/li>\n
  4. General Administrative Power of Attorney for the legal representative in El Salvador.<\/li>\n
  5. Payroll of foreign personnel designated in the country.<\/li>\n
  6. Initial balance and certification of resources allocated to project development in El Salvador.<\/li>\n<\/ol>\n

    Additional documentation for the Registry of Non-Profit Associations and Foundations<\/strong><\/h3>\n

    As of June 7, 2022, the\u00a0Directorate for the Registration of Non-Profit Associations and Foundations<\/a>\u00a0has implemented new requirements for the incorporation and registration of these entities. These measures comply with Article 2 of the\u00a0Anti-Money and Asset Laundering Law<\/a>\u00a0and Article 83 of the\u00a0Instructions for the Prevention, Detection, and Control of Money and Asset Laundering, Terrorist Financing, and the Financing of the Proliferation of Weapons of Mass Destruction<\/a>\u00a0of the Financial Investigation Unit.<\/p>\n

    Required Documentation<\/strong><\/h4>\n

    All entities registered with the Registry of Non-Profit Associations and Foundations must submit the following additional documentation to their financial information:<\/p>\n

      \n
    1. Proof of registration<\/strong>\u00a0of the entity, officer, or compliance office with the Financial Investigation Unit of the Attorney General’s Office.\u00a0FIU Registration<\/a><\/li>\n
    2. Minutes<\/strong>\u00a0with the appointment of the regular and alternate Compliance Officer, and each time there is a change in these positions.<\/li>\n<\/ol>\n

      Additional Obligations<\/strong><\/h4>\n

      In addition, they must comply with the obligations defined in Article 84 of the Instructions for the Prevention, Detection, and Control of Money Laundering, Terrorist Financing, and the Financing of the Proliferation of Weapons of Mass Destruction:<\/p>\n

        \n
      1. Maintain information<\/strong>\u00a0about the purpose and objectives of its stated activities, as well as the identity of the persons who own, control, or direct its activities, including senior officials and board members.<\/li>\n
      2. Have annual financial statements<\/strong>\u00a0that provide detailed breakdowns of income and expenses.<\/li>\n
      3. Adopt appropriate controls<\/strong>\u00a0to ensure that all funds are fully accounted for and used in accordance with the stated purpose and objectives of the activities.<\/li>\n
      4. Take reasonable steps<\/strong>\u00a0to confirm the identity, background, and good reputation of your beneficiaries.<\/li>\n
      5. Document the identity<\/strong>\u00a0of your major donors and respect donor confidentiality to prevent the use of charitable funds to finance terrorist activities.<\/li>\n
      6. Maintain records<\/strong>\u00a0of domestic and international transactions for a period of at least fifteen years, sufficiently detailed to verify that funds have been received and spent in accordance with the entity’s purpose and objectives.<\/li>\n
      7. Keep records<\/strong>\u00a0available to the competent authorities.<\/li>\n<\/ol>\n
