What is the difference between an association and a foundation in El Salvador?

Associations may be incorporated without any assets; in the case of foundations, the contribution of assets is a prerequisite for their incorporation.
Associations have membership and may include the payment of membership dues; foundations may not have membership, nor may they require their members to pay dues to increase their assets.
Foundations may be constituted by will; associations may not.
Foundations may be established by a single person; associations are established by a group of persons.
The purposes of foundations must be of public utility; those of associations, in addition to public utility purposes, may be of a guild, social or religious nature.

What are the requirements to form an NGO in El Salvador?

Foreign associations and foundations wishing to perform acts in El Salvador, in accordance with our laws on this matter, have the same rights as Salvadoran legal entities, and therefore may establish agencies, subsidiaries, branches or offices.

REQUIREMENTS TO ESTABLISH AN ASSOCIATION OR FOUNDATION (NGO) IN EL SALVADOR

To constitute the Bylaws that will govern the Association.
Once the bylaws have been approved, the articles of incorporation will be executed.
Prepare a list of the members of the entity.
To elect the first Board of Directors, as established in the Bylaws.
Prepare accounting books, minutes and membership registry books, which must be submitted to the Registry to be legalized together with the association’s articles of incorporation.
